Terms And Conditions

1. Booking and Payment

i. Advance reservations – more than 28 days before the start date – require a 25% online deposit with booking.

ii. Short notice reservations – less than 28 days of start date – require online payment in full at the time of reservation.

iii. Payments with an overseas credit card: the card issuer will debit your account in your local currency at the exchange rate applicable on the date of processing.

iv. Payment of remaining balance is due 28 days before the start date preferably by electronic bank transfer – (see clause 1.v)

v. Please ensure that Kaliyoga receives the full amount, irrespective of fluctuations in currency and third party transfer and processing charges.

vi. Bookings are not considered definite and no obligation to provide services shall exist between you and Kaliyoga until payment in full has been received by Kaliyoga.


2. Cancellation by you

i. Cancellation can only be made by the person(s) submitting the booking form. Notice of cancellation must be notified to Kaliyoga in writing. Cancellation will take effect the day such notification is received and your booking will be released.

ii. If you cancel 28 days or earlier in advance of your arrival date, your deposit will be refunded. 

iii. 01/01/2023 * UPDATE TO OUR CANCELLATION POLICY *
This update applies to anyone who makes a cancellation after the 1st January 2023 : an admin charge of 12% will be retained from the refundable amount. This does not affect customers who booked prior to 1st January 2023. 

iv. Cancellation within 28 days of your confirmed arrival date will result in forfeit of payment. (see section vi below).

v. Once a booking has been accepted refunds are subject to our cancellation policy and subject to limitations of our liability to you (see section v below).

vi. If you cancel and subsequently another customer can be found to take your place we may at our discretion permit you to defer your booking to another date or person, in which case a refund would be applicable. A 12% admin fee will apply to your refundable balance.

vii. Your booking is for the stated period of the retreat. Once the event has started, no refund or part refund or will be repaid in the event of cancellation or non-attendance by you. There are no refunds for an unused portion of the retreat.

viii. You indemnify Kaliyoga against claims for financial loss caused by events beyond Kaliyoga’s control.


3. Our liability to you

i. Kaliyoga accepts responsibility for ensuring that our contractual services are provided to a reasonable standard and our retreats and B&B are supplied as described. Kaliyoga reserves the right to cancel, postpone or re-schedule events due to circumstances beyond our reasonable control.

ii. Staff including teachers and course leaders may may change at Kaliyoga’s discretion.

iii. We are not responsible for the proportion of male/female guests in any group. We are not responsible for the individual behaviour of any guest.

iv. We will make reasonable effort to accommodate all customers but we reserve the right at our discretion to cancel your booking if we think that your behaviour is disrespectful or your attitude or mental health is deemed likely to upset staff or other guests. 

v. Activities on site and off site are undertaken at your own risk including yoga, hill walking, horse riding. We are not liable for any injuries that you may incur.  We are not liable for any medical or psychiatric conditions which may develop during or subsequent to your booking. We are not liable for loss of, or damage to, your personal property.

vi. We do not accept liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, national state of emergency, health epidemic, unforeseen changes in your personal circumstances or other events beyond our control and you agree to indemnify Kaliyoga against claims for financial loss caused by such events.

4. Flights & Transfers

i. Your travel arrangements are your responsibility and at your own cost.

ii. Kaliyoga is not responsible for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel.

5. Travel Insurance

i. Insurance is mandatory.

ii. We require that your travel insurance covers the activity of your booking as well as unexpected cancellation, sickness, losses, flight changes or cancellations due to the Covid-19 pandemic. Please bring the policy with you in the case of an emergency.

iii. UK residents: European Health Insurance Cards (EHIC) are still valid for travel to EU countries – please check that your card will not expire during your period of travel. Otherwise, apply for a Global Health Insurance Card (GHIC) that covers medical treatment in Europe, but not ambulances or residential charges for hospital stays

6. Group Bookings

i. Where a booking is made on behalf of several individuals the booking is conditional on the person signing the booking form having authorisation from all the individuals named on the booking form to enter into this contract. A deposit for every group member is required. If any member of the group can not come for any reason, their deposit is forfeit unless cancellation is given in writing within 60 days before the start date of their booking.

7. Your Medical Health / Pregnancy

i. If you have a medical condition, serious or otherwise, you MUST inform us in writing at the time of booking and provide a letter from your GP confirming that it is safe for you to attend a KaliYoga event with our advertised diet, yoga classes & and other physical activities that we arrange at your request (e.g. horse riding, hill walking etc.). In the interests of your well-being we may at our discretion decline your stay at Kaliyoga.

ii. If an emergency arises we will do everything in our power to assist you but Kaliyoga is not responsible for the outcome of any such emergency.

iii. Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain.

iv. In the case of a medical emergency we will drive the guest to the Orgiva health centre free of charge. If a hospital transfer is required by ambulance, we will chaperone the guest to the hospital in Granada or Motril to assist with translation for a flat fee of €300.

v. Pregnancy: it is not advisable to practice yoga during the first trimester, particularly with any history of miscarriage. If you have been a regular yoga practitioner for several years and your internal muscles are used to yoga postures and if you have a letter from your doctor stating that it is safe for you to engage in the activities that we provide, then you may attend a Kaliyoga retreat during your second and third trimester. Guidance from our yoga teacher must be observed.


8. Food –  Allergies – Medication – Alcohol

i. Kaliyoga’s kitchen is 100% vegetarian with vegan, gluten free and lactose free options.

ii. If you have a serious dietary allergy you must provide Kaliyoga with a note from your doctor or health practitioner stating the severity of your condition and the nature of any reaction that would occur if you consumed any ingredient to which you are intolerant. Directly on your arrival as a precaution you will remind the manager and kitchen staff about your dietary needs. You are responsible for your own dietary health and you must bring any personal medication with you. If we can not cater to your allergy needs we may need to decline your booking for your own health and safety.

iii. We are not responsible for adverse reaction to ingredients that you consume.

iv. You must let us know if you take prescribed anti-depressants or if you are epileptic.

v. Kaliyoga’s staff will not apply medication on your behalf.

vi. Alcohol is not permitted on the premises.

vii. If you are under the influence of drink or drugs at any time, the experiene of your retreat will be tied to that mental state and therefore your retreat will be compromised therefore we reserve the right to terminate your booking in regard to possession of alcohol or drugs on site.

9. Mobile phones and portable devices

i. Retreats are designed for people to be quiet and reflective.

ii. In the interests of  creating a positive retreat atmosphere for all guests, portable devices including mobile phones and tablets should not be used at the dining table nor in the yoga studio. The yoga teacher may at their discretion grant permission to take photos in the yoga studio. If you need to make phone calls and/or carry out work-related activities on a mobile device, please do so in the privacy of your room and not in the communal areas.

iii. If you listen to music please use headphones and set the volume to a reasonable level that can not be heard by people around you.

iv. In order to maintain guest privacy and confidentiality, photos and videos of your fellow guests may not be taken, stored, nor shared digitally without their prior permission.

10. Age / Gender

i. All genders are welcome. The minimum age of any participant is 16 unless otherwise agreed in writing at our discretion. There is no maximum age.

11. Gift Certificates – issue and redemption

i. Gift Certificates are issued by and are the property of Kaliyoga SL.
ii. Our Gift Certificates are sold subject to the following Terms and Conditions and by purchasing a Kaliyoga Gift Certificate you will be deemed to have read and accepted these Terms and Conditions.
iii. Kaliyoga Gift Certificates are issued for redemption at any participating Kaliyoga outlet in part-exchange for the provision of accommodation, services or benefits equivalent in value to its full face value, referred to in these terms and conditions as “the services”.
iv. Kaliyoga Gift Certificates are purchased on www.kaliyoga.com and the terms and conditions applicable to the use of that web-site, including Kaliyoga’s privacy policy, will apply. Payment will be made online using the relevant e-commerce portal on www.kaliyoga.com.
v. Kaliyoga Gift Certificates may be cancelled after issue if any information supplied at the time of purchase is untrue or inaccurate, or if payment is declined or incorrect cardholder details and/or billing information have been supplied. A 5% admin deduction will be applied to a refund.
vi.
• Each Kaliyoga Gift Certificate features a unique reference code and date stamp
• Gift certificates may only be used for whole or part payment for room bookings in participating Kaliyoga outlets.
• Gift certificates for a specific course or services are redeemable subject to availability of the course or service.
• All room bookings exchanged with Gift Certificates must be pre-booked online at www.kaliyoga.com or by phone via our Reservations Team.
vii.
• The Gift Certificate(s) must be presented upon check-in at Kaliyoga prior to any services being supplied or used.
• Gift Certificates may not be exchanged wholly or partly for cash [nor will any change be given].
• Gift Certificates are valid for 12 months from the date of issue and may not be redeemed beyond that period, except where an alternative duration of validity has been confirmed in writing by the company.
• We cannot accept responsibility for the loss or theft of Gift Certificates. Gift Certificates are not replaceable if lost, damaged, stolen or expired and are void if altered, photocopied or reproduced.
• Your use of Gift Certificates at certain destinations may be subject to government approvals, regulations, restrictions and applicable taxes of the respective destination.
• If your use of Gift Certificates raises any tax liability on you, including disclosure, then such liability is your sole responsibility.
• Gift Certificates are only valid when displaying a voucher number and date stamp.
• Participating outlets will require a credit card deposit when taking a booking for accommodation.
• Gift Certificates may be redeemed once at full face value within the period of validity at the Kaliyoga outlet in exchange for the services.
• In the event that the value of the Gift Certificate does not cover the full cost of the accommodation or other services provided by the KaliYoga outlet, then the balance must be paid by the redeemer of the Gift Certificate to the Kaliyoga outlet in cash or by valid debit/credit card and the Kaliyoga outlet may require a valid debit/credit card deposit for such costs when accepting a reservation or redeeming the Gift Certificate.
• If issued in a currency other than the official currency of the Kaliyoga outlet at which it is redeemed then it will be converted at full face value into the official currency of the redeeming Kaliyoga outlet at the prevailing foreign exchange rate then offered by that Kaliyoga outlet.
• Kaliyoga reserves the right to change these terms and conditions without notice.
viii. Any accommodation reservation made at a Kaliyoga outlet involving a Kaliyoga Gift Certificate will be subject to Kaliyoga’s standard Terms and Conditions which are set out at www.kaliyoga.com/kaliyoga-retreats-terms-conditions/.
ix. Kaliyoga acts solely as the issuer of Kaliyoga Gift Certificates and upon redemption of the Gift Certificate the legal contract for provision of the benefits and any other services is made with the Kaliyoga outlet which thereafter assumes full responsibility and liability for the provision of such benefits and any other services and it is a condition of the sale of the Gift Certificate that KaliYoga has no liability whatsoever for the provision of any benefits or any related issues or consequences.

 

12. Jurisdiction

Any use of the Kaliyoga website www.kaliyoga.com or any related Kaliyoga website will be subject to our terms & conditions and will be subject to the laws of Spain and the courts of Spain shall have exclusive jurisdiction in relation to any disputes.
 

13. Complaints

i. We really value your feedback. Giving us feedback when you are not happy with our service gives us the opportunity to put things right for you and improve our service to others. Feel free to email us at a convenient time for you and we will do our best to respond as quickly as possible. We will listen to you and put matters right if we can.

ii. If you want to complain, please give us the following details:
• Your name and address
• Your booking reference or your customer account number
• A phone number where you would like us to call you
• A clear description of your concerns or complaint
• Details of what you would like to do to put things right
• Copies if any relevant correspondence

iv. What we will do and how long it will take
We will do our best to sort out your complaint immediately. If we can’t do that, we aim to deal with your complaint the next working day. Sometimes it may take longer to investigate your concerns fully.
If this is the case we will do the following:
– give you the name and contact details of the person who will be investigating your complaint.
– respond to you within twentyeight working days.

v. If more time is needed to resolve the issue, we will write to you explaining what is happening and when we expect to sort out your complaint. We will send you either a final response or a detailed report on our progress within eight weeks.

vi. What to do if you are still not happy
We aim to deal with your complaint as quickly as possible to your complete satisfaction. If you are not happy with the response you receive from us, please contact the person who handled your complaint. Then will then agree the next steps with you. We always aim to deal with your concerns ourselves. Our terms & conditions are construed and bound by the laws in the geographic location where the service, product or treatment that you have purchased is intended to be delivered, rendered or consumed.

14. GDPR Policy

i. How we use your personal data
We are committed to protecting your personal data.
We will use your non-sensitive personal data to (i) register you as a new client, (ii) manage payment, (iii) manage orders (iv) to manage our relationship with you, (v) send you details of our goods and services.
Our legal grounds for processing your data in relation to points (i) to (iv) above are for performance of a contract with you and in relation to (v) above are necessary for our legitimate interests to develop our products/services and grow our business.
We will not share your details with third parties for marketing purposes.
ii. Disclosure of your personal data
We may have to share your personal data with (i) service providers who provide IT and system administration support, (ii) professional advisors including lawyers, bankers, auditors and insurers (iii) HMRC and other regulatory authorities
We require all of these third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. They are only allowed to process your personal data on our instructions.
iii. International transfers
We use an external third party to deliver emails on our behalf, and we may share your personal data with them in order that we can carry out certain functions, such as communicating about an enquiry, processing your order and to assist with the general running of our site.
While this party is based outside of the European Economic Area, they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the US.
We may also share your personal data with third party website agencies where this is necessary for us to carry out our obligations to you. We require all third parties to respect the security of your personal data and to treat it in accordance with the law.
We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
In certain circumstances you can ask us to delete your data. See the section entitled ‘your rights’ below for more information.
We may anonymise your personal data (so that you can no longer be identified from such data) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
iv. Data security
Protecting your data is important to us and we have put in place security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We also limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know such data. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breaches and will notify you and any applicable regulator of a breach where we are legally required to do so.
In certain circumstances you can ask us to delete your data. See the section entitled ‘your rights’ below for more information.

v. Data retention
We will only keep your personal data for as long as is necessary to fulfil the purposes for which we collected it. We may retain your data to satisfy any legal, accounting, or reporting requirements. So, for example, we need to keep certain information about you for six years after you cease to be a client for tax purposes.
You have the right to ask us to delete the personal data we hold about you in certain circumstances. See section 6 below.
vi. Your rights
You are able to exercise certain rights in relation to your personal data that we process. These are set out in more detail here
In relation to a Subject Access Right request, you may request that we inform you of the data we hold about you and how we process it. We will not charge a fee for responding to this request unless your request is clearly unfounded, repetitive or excessive in which case we may charge a reasonable fee or decline to respond.
We will, in most cases, reply within one month of the date of the request unless your request is complex or you have made a large number of requests in which case we will notify you of any delay and will in any event reply within three months.

vii. Keeping your data up to date
We have a duty to keep your personal data up to date and accurate so from time to time we will contact you to ask you to confirm that your personal data is still accurate and up to date.
If there are any changes to your personal data (such as a change of address) please let us know as soon as possible by signing in to your online customer account and updating the relevant section.

viii. Complaints about data
We are committed to protecting your personal data but if for some reason you are not happy with any aspect of how we collect and use your data, you have the right to complain to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues.
We should be grateful if you would contact us first if you do have a complaint so that we can try to resolve it for you.
We may change this privacy notice from time to time and shall notify you of any changes.

ix. Technology
Kaliyoga.com uses cookies, tracking pixels and related technologies. Cookies are small data files that are stored on your device. Our site uses cookies for a variety of purposes including to operate and personalize the website. Also, cookies may also be used to track how you use the site to target ads to you on other websites. Cookies are used for administration of the site system. Our cookies do not automatically capture or store any personal data.
