1. General Terms of Booking and Payment

Payments – Your payments are refundable until 40 days before the retreat start date, after which they may be transferable to another course or person at our discretion. Returned payments are subject to a £50 pound handling charge. Cancellation will incur cancellation charges as set out in paragraph 6 below.

Your booking is not considered definite and no contract will exist between you and Kaliyoga until we receive full payment from you.

Our policy for Credit Cards and Data Privacy is set out in paragraph 14 below.

Deposit Payments – Full payment is due at the time of booking. Bookings eight weeks or more in advance of the event date are entitled to secure the reservation with a 50% deposit. Balance monies are due 40 days before the start date of the event.

The price is the exact amount to be received by us, irrespective of fluctuations in currency and irrespective of any third party transfer charges. If you choose to pay by electronic transfer, please instruct your bank to charge all costs to you in order to avoid a shortfall in the amount that we receive.

Details for bank to bank transfer (BACS) will be sent to you on request.

2.  Age / Gender

All genders are welcome. The minimum age of any participant is 16 unless otherwise agreed in writing at our discretion. There is no maximum age.

3. Food & Drink

Kaliyoga provides vegetarian ingredients with options suitable for people with food allergies.
Animal free ingredients are available for vegans.
Alcohol is not permitted on the premises.

4. Use of Mobile Phones and WiFi Devices

Retreats are designed for people to be quiet and reflective. Please be discrete when talking on your phone. Listening to music on headphones is permitted, but please use your discretion. Mobile phones and other WiFi devices should not be used at the dining table, around the pool, nor in the yoga studio. Posting photos and videos of the retreat is permitted. Permission must be sought prior to posting images of your fellow guests on social media.

5. Travel Arrangements

All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost and at your own risk unless otherwise specified.

Airport Transfers

You communicate your logistics to our travel co-ordinators via your booking form or by email. Transfer vehicles are arranged and operated by owner-drivers with whom you enter into a private agreement. The driver is responsible for your safety and well-being for the duration of the transfer journey. On arrival at your destination, you will be asked to compensate the driver directly.

6.0 Travel Insurance

We require that your travel insurance covers the activity of this retreat as well as unexpected cancellation, sickness, losses, and all the usual risks. You should bring the policy with you in the case of an emergency.

6.1 Your Health

If you have a medical condition, serious or otherwise, you MUST inform Kaliyoga at the time of booking and provide a letter from your GP confirming that it is safe for you to attend a Kaliyoga retreat with our advertised diet, yoga classes & and other physical activities that we arrange at your request (e.g. horse riding, hill walking etc.). In the interests of your well-being we may decline your stay at Kaliyoga.

If an emergency arises we will do everything in our power to assist you but Kaliyoga is not responsible for the outcome of any such emergency.

Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain.

Pregnancy: Unless you have been a regular yoga practitioner for several years it is not advisable to practice yoga during the first trimester, particularly if there is any history of miscarriage. During the remainder of pregnancy, it is more suitable to attend pregnancy yoga classes. However, if you have been a regular yoga practitioner for several years and your internal muscles are used to yoga postures and if you have a letter from your doctor stating that it is safe for you to engage in the activities that we provide, then you can attend a Kaliyoga retreat during your second and third trimester. Guidance from our yoga teacher must be observed. Please note that on Juice Fasting Detox retreats we do not accept women at any stage of pregnancy.

7. Cancellation by you

You (or any member of your party) may cancel your booking at any time, providing that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us. As this incurs administrative costs, returned payments are subject to a £50 pound handling charge and in addition, if such cancellation is made within less than 40 days before the start of the retreat, we will retain 100% of the cost of the retreat. However, if another person can be found to take your place, then we may offer you a 50% refund at our discretion. Refunds and returned payments are normally settled within 10 working days of the date of cancellation. Otherwise, once a booking has been accepted no payment is refundable unless the course is cancelled. Once the retreat has begun, no refund or part refund or unused portion of the retreat will be repaid in the event of cancellation by you. Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim.

8. Amendments by Kaliyoga Retreats

Occasionally, changes may have to be made (e.g., yoga teacher, class times or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed for any reason, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

9. Cancellation by Kaliyoga Retreats

We reserve the right in any circumstances to cancel a retreat, in which case we will offer a full refund of all monies paid within 10 working days. In particular, our retreats require a minimum number of at least 50% of the participants to have booked by 7 days before the start date. If this minimum number is not reached by that date we may cancel and refund the money to you. We will make reasonable effort to accommodate all customers, but we reserve the right, at our discretion, to refuse you a space on a course if we think that your behaviour is disrespectful or your attitude is deemed likely to upset staff and/or other guests. 

10. Our liability to you

We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

We do not accept any liability for cancellations, delays or changes caused by war, the threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

We are not liable for any injuries you may incur. Yoga classes are undertaken at your own risk. We are not liable for any medical or psychiatric conditions which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.

We are not responsible for the proportion of male/female guests in any group. We are not responsible for the individual behaviour of any guest.

We reserve the right to ask you to leave the premises at our discretion if your behaviour is disruptive or abusive.

11. Group Bookings

Where a booking is made on behalf of several individuals the booking is conditional on the person signing the booking form having authorisation from all the individuals named on the booking form to enter into this contract. A deposit from every group member is required. If any member of the group can not come for any reason, their deposit is forfeit.

12. Additional conditions for Detox Retreats

Booking: In order to be accepted on a Detox retreat we request that you complete and return a health questionnaire. This will be sent to you by email.
Contraindications: A Detox retreat is not appropriate if you are currently being treated for cancer, or receiving chemotherapy or radiotherapy, or undergoing treatment for a life-threatening illness, or if you are an insulin dependent diabetic, or of you have heart problems or high blood pressure. A Detox retreat is not suitable if you are pregnant or breastfeeding. Anyone with chronic illness should consult with their registered health practitioner before attending. In certain cases, we may ask for a letter from your health practitioner to confirm that you are well enough to participate in the retreat.

13. Gift Certificate Terms and Conditions

Gift Certificates are issued by and are the property of Kaliyoga SL.
Our Gift Certificates are sold subject to the following Terms and Conditions and by purchasing a Kaliyoga Gift Certificate you will be deemed to have read and accepted these Terms and Conditions.
Kaliyoga Gift Certificates are issued for redemption at any participating Kaliyoga outlet in part-exchange for the provision of accommodation, services or benefits equivalent in value to its full face value, referred to in these terms and conditions as “the services”.
Kaliyoga Gift Certificates are purchased on www.kaliyoga.com and the terms and conditions applicable to the use of that web-site, including Kaliyoga’s privacy policy, will apply. Payment will be made online using the relevant e-commerce portal on www.kaliyoga.com. Kaliyoga Gift Certificates may be cancelled after issue if any information supplied at the time of purchase is untrue or inaccurate, or if payment is declined or incorrect cardholder details and/or billing information have been supplied.
Each Kaliyoga Gift Certificate features a unique reference code and date stamp and:
• Gift certificates may only be used for whole or part payment for room bookings in participating Kaliyoga outlets.
• Gift certificates are redeemable subject to availability at the discretion of a Kaliyoga manager. 
• Its redemption will be subject to the availability of the services at Kaliyoga which are offered at the discretion of Kaliyoga. 
• All room bookings exchanged for Gift Certificates must be pre-booked online at www.kaliyoga.com or by phone via our Reservations Team. The Gift Certificate(s) must be presented upon check-in at Kaliyoga prior to any services being supplied or used. 
• Gift Certificates may not be exchanged wholly or partly for cash [nor will any change be given].
• Gift Certificates are valid for 12 months from the date of issue and may not be redeemed beyond that period. 
• We cannot accept responsibility for the loss or theft of Gift Certificates. Gift Certificates are not replaceable if lost, damaged, stolen or expired and are void if altered, photocopied or reproduced. 
• Your use of Gift Certificates at certain destinations may be subject to government approvals, regulations, restrictions and applicable taxes of the respective destination. 
• If your use of Gift Certificates raises any tax liability on you, including disclosure, then such liability is your sole responsibility.
• Gift Certificates are only valid when displaying a voucher number and date stamp. 
• Participating outlets will require a credit card deposit when taking a booking for accommodation. 
• Gift Certificates may be redeemed once at full face value within the period of validity at Kaliyoga outlet in exchange for the services.
• In the event that the value of the Gift Certificate does not cover the full cost of the accommodation or other services provided by the Kaliyoga outlet, then the balance must be paid by the redeemer of the Gift Certificate to the Kaliyoga outlet in cash or by valid debit/credit card and the Kaliyoga outlet may require a valid debit/credit card deposit for such costs when accepting a reservation or redeeming the Gift Certificate.
• If issued in a currency other than the official currency of the Kaliyoga outlet at which it is redeemed then it will be converted at full face value into the official currency of the redeeming Kaliyoga outlet at the prevailing foreign exchange rate then offered by that Kaliyoga outlet.
• Kaliyoga reserves the right to change these terms and conditions without notice. 
Any accommodation reservation made at a Kaliyoga outlet involving a Kaliyoga Gift Certificate will be subject to Kaliyoga’s standard Terms and Conditions which are set out at www.kaliyoga.com/kaliyoga-retreats-terms-conditions/.
Kaliyoga acts solely as the issuer of Kaliyoga Gift Certificates and upon redemption of the Gift Certificate the legal contract for provision of the benefits and any other services is made with the Kaliyoga outlet which thereafter assumes full responsibility and liability for the provision of such benefits and any other services and it is a condition of the sale of the Gift Certificate that Kaliyoga has no liability whatsoever for the provision of any benefits or any related issues or consequences.
Any use of the Kaliyoga website www.kaliyoga.com or any related Kaliyoga website will be subject to the terms & conditions and Kaliyoga Gift Certificates are subject to the laws of Spain and the courts of Spain shall have exclusive jurisdiction in relation to any disputes. 

14. Complaints

Dealing with complaints in a positive way

We really value your feedback. Giving us feedback when you are not happy with our service gives us the opportunity to put things right for you and improve our service to others. Feel free to email us at a convenient time for you and we will do our best to respond as quickly as possible. We will listen to you and put matters right if we can.

• A clear description of your concerns or complaint

What we will do and how long it will take
We will do our best to sort out your complaint immediately. If we can’t do that, we aim to deal with your complaint the next working day. Sometimes it may take longer to investigate your concerns fully. If this is the case, then we will do the following:
Give you the name and contact details of the person who will be investigating your complaint
Write to you within five working days
Keep you updated with our progress

If your complaint takes longer for us to investigate, we aim to find a solution within four weeks.
If we are not able to do so, we will always write to you explaining what is happening and when we expect to sort out your complaint.
We will send you either a final response or a detailed report on our progress within eight weeks.

What to do if you are still not happy
We aim to deal with your complaint as quickly as possible to your complete satisfaction. If you are not happy with the response you receive from us, please contact the person who handled your complaint. Then will then agree the next steps with you. We always aim to deal with your concerns ourselves.

15. Privacy Policy

1. How we use your personal data
We are committed to protecting your personal data.
We will use your non-sensitive personal data to (i) register you as a new client, (ii) manage payment, (iii) manage orders (iv) to manage our relationship with you, (v) send you details of our goods and services.
Our legal grounds for processing your data are in relation to points (i) to (iv) above are for performance of a contract with you and in relation to (v) above, necessary for our legitimate interests to develop our products/services and grow our business.
We will not share your details with third parties for marketing purposes.
2. Disclosure of your personal data
We may have to share your personal data with (i) service providers who provide IT and system administration support, (ii) professional advisors including lawyers, bankers, auditors and insurers (iii) HMRC and other regulatory authorities
We require all of these third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. They are only allowed to process your personal data on our instructions.
3. International transfers
We use an external third party to deliver emails on our behalf, and we may share your personal data with them in order that we can carry out certain functions, such as communicating about an enquiry, processing your order and to assist with the general running of our site.
While this party is based outside of the European Economic Area, they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the US.
We may also share your personal data with third party website agencies where this is necessary for us to carry out our obligations to you. We require all third parties to respect the security of your personal data and to treat it in accordance with the law.
We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
In certain circumstances you can ask us to delete your data. See the section entitled ‘your rights’ below for more information.
We may anonymise your personal data (so that you can no longer be identified from such data) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
4. Data security
Protecting your data is important to us and we have put in place security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. We also limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know such data. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breaches and will notify you and any applicable regulator of a breach where we are legally required to do so.
In certain circumstances you can ask us to delete your data. See the section entitled ‘your rights’ below for more information.
We may anonymise your personal data (so that you can no longer be identified from such data) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
5. Data retention
We will only keep your personal data for as long as is necessary to fulfil the purposes for which we collected it. We may retain your data to satisfy any legal, accounting, or reporting requirements. So, for example, we need to keep certain information about you for six years after you cease to be a client for tax purposes.
You have the right to ask us to delete the personal data we hold about you in certain circumstances. See section 6 below.
6. Your rights
You are able to exercise certain rights in relation to your personal data that we process. These are set out in more detail here
In relation to a Subject Access Right request, you may request that we inform you of the data we hold about you and how we process it. We will not charge a fee for responding to this request unless your request is clearly unfounded, repetitive or excessive in which case we may charge a reasonable fee or decline to respond.
We will, in most cases, reply within one month of the date of the request unless your request is complex or you have made a large number of requests in which case we will notify you of any delay and will in any event reply within three months.

7. Keeping your data up to date
We have a duty to keep your personal data up to date and accurate so from time to time we will contact you to ask you to confirm that your personal data is still accurate and up to date.
If there are any changes to your personal data (such as a change of address) please let us know as soon as possible by signing in to your online customer account and updating the relevant section.
8. Complaints
We are committed to protecting your personal data but if for some reason you are not happy with any aspect of how we collect and use your data, you have the right to complain to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues.
We should be grateful if you would contact us first if you do have a complaint so that we can try to resolve it for you.
We may change this privacy notice from time to time and shall notify you of any changes.
9. Technology
Kaliyoga.com uses cookies, tracking pixels and related technologies. Cookies are small data files that are stored on your device. Our site uses cookies for a variety of purposes including to operate and personalize the website. Also, cookies may also be used to track how you use the site to target ads to you on other websites. Cookies are used for administration of the site system. Our cookies do not automatically capture or store any personal data. However, if you’d prefer to restrict, block or delete cookies from Kaliyoga.com, you can do so from your browser. This information is in compliance with recent legislation.
